Overview
As of January 21, 2025, the Canadian government has revised the rules for Spousal Open Work Permits (SOWPs). According to the National Occupation Classification (NOC) system, these modifications limit SOWP eligibility to spouses of foreign workers working in particular occupations, namely those in:
- The highest skill level, TEER 0,
- TEER 1
- Some TEER 2 and TEER 3 professions
The primary foreign worker must have had a work visa for at least 16 months at the time of the spouse’s SOWP application in order to be eligible.
Eligible renewals and valid permits granted under prior regulations are unaffected by these changes. Previously, spouses of workers in all occupations were eligible for the SOWP.

SOWP Eligibility Requirements
To submit a SOWP application, make sure:
1. Your spouse is employed in a TEER 0, 1, 2, or 3 occupation that is eligible.
2. At the time of application, your spouse’s work permit is valid for a minimum of 16 months.
3. You present supporting documentation, such as evidence of your relationship and your eligibility to work in Canada.

1. Fill out the eligibility form provided by the IRCC to obtain a customized checklist.
2. Compile the necessary paperwork, including:
- Evidence of a link.
- Verification of your spouse’s employment and work permit status.
3. Create an IRCC secure account, log in, and attach supporting documentation.
4. Submit your application and pay the necessary payments.
Context and Upcoming Plans
By taking these steps, SOWP issuance will be in line with Canada’s economic goals, which include skilled trades and healthcare. The modifications are a part of a larger plan to control the number of temporary residents and cut the number of SOWPs issued by 150,000 over a three-year period.
